The following Terms of Use (“Terms”) are entered into by and between you and HNK Interior Design (“HNK Design,” “We”, “Our” or “Us”) and govern your access to and use of https://hnkdesign.com/ (the “Site”) or other products, programs, and services, including any content, functionality, and services offered on or through the Site, whether as a guest or a registered user. HNK Interior Design may update or modify these Terms of Use at any time without notice, and such updated versions will be posted on this site. You are responsible for periodically checking the Terms of Use.
The term “you” refers to anyone who uses, visits, and/or views the Site. By visiting and using the Site, you accept and agree to be bound by these Terms of Use, including our Disclaimer and Privacy Policy posted on the Site and incorporated herein by reference.
Your continued use of the Site after posting of any changes, updates, or modifications to these Terms of Use constitutes your acceptance of those changes and updates. You must not access the Site if you do not wish to be bound by these Terms of Use.

You expressly waive your right to bring any legal claims against HNK Interior Design, now or in the future, arising out of or related to the Site. In the event of any dispute, claim, or controversy arising out of or relating to your use of the Site, the terms and conditions shall be construed in accordance with the rules and regulations of the state of California and the United States.
You agree to consent and submit to the jurisdiction of the state and federal courts located in California without regard to the principles of conflict of law or where the parties are located at the time a dispute arises.
You agree to resolve any disputes or claims first through mandatory arbitration in the state of California and shall bear the full cost of arbitration as permitted by law. Your good faith participation in arbitration is a condition precedent to pursuing any other legal or equitable remedies available, such as litigation or any other legal procedure. You also agree that in the event a legal claim is initiated after the required arbitration, the prevailing party shall be entitled to recover reasonable attorney’s fees and other costs associated with the legal action.
All content on the Site, including but not limited to text, posts, logos, marks, graphics, files, materials, services, products, videos, audio, applications, computer code, designs, downloads and all other information here (collectively, the “Content”) is owned by us and is protected by copyright, trademark and other intellectual property and unfair competition laws with the exception of any content from others that we are lawfully permitted to use.
The Sites and its entire contents, features, and functionality, including, but not limited, to all information, software, text, displays, images, video, layouts, graphics, and audio, and the design, selection, and arrangement thereof (collectively, the “Content”) are protected by one or more copyrights, trademarks, patents, trade secrets and/or other proprietary rights and are owned by HNK Interior Design, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
Except as expressly set forth herein, use of the Site does not constitute a grant of any license or other right to use or exploit any of these proprietary rights.
These Terms permit you to use the Sites for your personal, non-commercial, non-transferable, informational, and educational use only while ensuring it’s not in violation of any copyright, trademark, intellectual property, or proprietary rights.
For any Content or information that you send, email, submit, upload, display, post, or transmit to us on the Site or any of our social media sites, you warrant that you are the owner of that content or have express permission from the owner to use and distribute the content to us. You grant us and our officers, employees, successors, shareholders, partners and anyone else working for us a royalty-free, perpetual, irrevocable, worldwide, non-exclusive right and license to identify you, publish, post, reformat, copy, distribute, display, edit, reproduce any Content provided by you on our Site and any of our social media sites for any purpose. You shall be solely liable for any damages resulting from any infringement of copyrights, trademarks, or other proprietary rights of any Content or information that you provide to us.

You agree to defend, indemnify, and otherwise hold HNK Design and our successors and assigns, our officers, directors, agents, employees, assigns, licensors, suppliers, Third-Party Content Providers, and service partners, harmless from and against any causes of action, including any claims, demands, losses, fees, expenses (including legal fees and expenses), costs, liabilities, and damages related to or arising out of your violation of these Terms of Use, including, but not limited to, any use of the Sites’ content, products, programs, or services other than as expressly authorized in these Terms, or your use of any information obtained from the Site.
If you are a California resident or could otherwise claim the protections of California Law, you acknowledge that you have read and understood section 1542 of the California Civil Code, which reads as follows: “A general release does not extend to the claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release which, if known by him or her, must have materially affected his or her settlement with the debtor.” You hereby expressly waive and relinquish all rights and benefits under that section and any law or jurisdiction of similar effect with respect to your release of any claims you may have against HNK Interior Design.
These Terms of Use, along with our Privacy Policy and Disclaimer, constitute the entire agreement between you and us with respect to the Site. It supersedes all prior or contemporaneous communications, negotiations, discussions, or proposals we may have had with you, whether in electronic, oral, or written form. A printed version of this agreement, including our Privacy Policy and Disclaimer, shall be admissible in judicial or administrative proceedings with respect to the Site and given the same effect as other business contracts and documents kept and maintained in printed form.
